Factors The Court Considers

- The duration of the marriage
- The standard of living set during the marriage
- The age of a requesting spouse as well as his or her physical and emotional health
- The ability of both parties to be self-sufficient
- The ability of the higher earner to pay
- The division of marital property
Maintenance payments stop if the spouse receiving support marries or files for a new domestic partnership. It is also possible to petition the court to modify maintenance payments if there has been a substantial change in circumstances, for example, a significant increase or decrease in salary for either party.
