Seattle Child Support Attorney
Washington state law requires both parents to contribute to the support of their child until the child graduates from high school. Child support typically is a monthly payment that one parent makes to the child’s other parent — the custodial parent — to assist with the costs of each child’s basic needs.
The amount of a payment, which is also known as the “basic support obligation,” is based on a statutory formula provided in the Washington State Child Support Schedule. The primary factor in determining the amount of child support is the number of children and the combined net income of both parents.
The court may set the amount at more or less than what the formula stipulates due to special circumstances in the financial situation of either a parent or the child. This is known as a deviation. Deviations may be allowed if:
- A parent is paying additional child support to the parent of a different child
- Care of the child is split evenly and expenses are already shared
- A child has special needs or extraordinary expenses
- The parents’ combined net income exceeds a certain threshold
Protect Your Rights Regarding Child Support
At the law office of Kenneth F. Bromet, Attorney at Law, my experience and thorough knowledge of Washington child support laws allow me to protect your interests as well as your child’s.
Despite its general adherence to a rigid formula, child support in Washington can be a complex matter. It is critical to secure the services of an experienced Seattle child support lawyer who will protect your rights, whether you expect to pay child support or receive it.
For example, if one or both parents are self-employed or own a business, determining total net income can be complicated. Similarly, if one parent routinely receives pay-for-performance bonuses or performs seasonal work that causes his or her income to fluctuate, setting the right child support amount can be difficult.
Because I have practiced law for more than 35 years, I have seen almost every situation imaginable when it comes to determining parents’ net income. I understand methods for obtaining accurate salary figures in order to reach the right amount of child support.
