As a dedicated juvenile law attorney, I provide comprehensive representation for the various parties. I understand the emotional and stressful situations that can cause parents to seek relief from the court. With an at-risk youth petition, you are basically giving a judge authority to establish rules for an out-of-your-control child. These petitions are designed to provide structure for an out-of-control juvenile, while also providing counseling and other services as necessary or appropriate for the family. At Kenneth F.   • Skipping school
  • Abusing medications
  • Taking drugs
  • Picking fights at home
  • Disobeying curfew

After an initial hearing, a judge will establish boundaries for your child and discuss the consequences — which can include time in juvenile detention — if your child does not comply with the court order. The court can and will order services for the parent(s) as well, if appropriate.

CHINS petitions allow juveniles to ask the court for foster care placement or other alternatives. Typically, juveniles file these after their parents file an at-risk youth petition. However, many situations can contribute to a CHINS filing, including:

  • Child abuse
  • Neglect
  • Parental drug addiction

Additionally, parents or guardians who feel they can no longer care for a child can file the petition. Petitions are granted for nine-month durations. The purpose of CHINS petitions is to provide counseling, evaluations and groundwork for both the parents and children to work together to achieve an effective solution, while placing the child outside of the family home.
